Why Drug Charges Matter

Drug charges range from simple possession to large-scale trafficking investigations, and penalties increase significantly with the type and quantity of the substance alleged.

Many drug cases involve search warrants, vehicle stops, confidential informants, wiretaps or digital evidence. Each raises its own legal questions under the Charter of Rights and Freedoms, and a careful review of the investigation is often where the defence begins.

Serious Penalties

Trafficking-related offences can carry significant custodial sentences.

Search & Seizure

Warrants and warrantless searches must meet strict legal standards.

Immigration Risk

Drug convictions can have serious consequences for non-citizens.

Future Opportunities

A record can affect employment, travel and professional licensing.

What We Do

Scrutinizing the investigation behind the charge.

We review the warrant materials, police notes, surveillance, forensic analysis and any digital evidence to understand exactly how the case was built.

Where the evidence was obtained in breach of your rights, we may bring Charter applications to challenge its admissibility. Where alternatives such as diversion may be available, we explore them.

Warrant Review

Testing whether search warrants were properly obtained and executed.

Charter Litigation

Search, detention and right to counsel issues.

Possession & Knowledge

Whether the Crown can prove knowledge and control.

Resolution Options

Exploring diversion and appropriate outcomes where available.

FAQ’s

Frequently Asked Questions

Clear answers to common questions about drug charges in Ontario.

01 What Is Possession For The Purpose Of Trafficking?

It is an allegation that you possessed a controlled substance intending to sell, give, transfer or distribute it. The Crown often relies on circumstantial evidence such as quantity, packaging, scales, cash or messages. Whether that evidence proves the purpose is frequently contested.

02 What If The Drugs Were Found In A Car Or Home I Share?

The Crown must prove that you knew about the substance and had control over it. Being near drugs, or sharing a space where they were found, is not by itself enough. These issues depend heavily on the facts.

03 Can Evidence Be Excluded If Police Searched Illegally?

Possibly. If a search breached your rights under section 8 of the Charter, the court may exclude the evidence under section 24(2) if admitting it would bring the administration of justice into disrepute. The court weighs several factors, so outcomes vary from case to case.

04 Is Diversion Available For Drug Charges?

In some cases, particularly simple possession, the Crown may consider alternatives such as diversion or a warning. Availability depends on the charge, the circumstances and Crown policy. We can assess whether it may be an option for you.

05 Will A Drug Conviction Affect My Immigration Status?

It may. Drug convictions can carry serious immigration consequences for permanent residents and other non-citizens. If you are not a Canadian citizen, tell your lawyer early so those consequences can be considered, and seek immigration advice as well.
