Why Fraud & Theft Charges Matter

Dishonesty offences can be especially damaging to employment, professional licensing, immigration status and the ability to be bonded or pass a background check.

Fraud cases may involve large volumes of financial records, bank documents, emails and forensic accounting. Penalties increase with the amount alleged and the circumstances, and the court may also order restitution. Careful review of the documentary record is often essential to the defence.

Career Impact

Dishonesty findings can affect employment and professional licences.

Complex Records

Financial evidence must be carefully analyzed and understood.

Restitution

Courts may order repayment in addition to other penalties.

Reputation

Allegations alone can have serious personal and business consequences.

What We Do

Clear analysis of complex financial evidence.

Fraud requires the Crown to prove dishonest conduct and a resulting deprivation or risk of deprivation. Many cases turn on intent, authority, accounting practices or the reliability of records.

We work through the disclosure in detail, retain forensic accounting support where appropriate, and advise you on defence and resolution options, including diversion for some lower-level matters.

Document Review

Organizing and analyzing financial and digital records.

Intent & Authority

Testing whether dishonesty can actually be proven.

Diversion Options

Exploring alternatives for eligible first-time matters.

Restitution Planning

Addressing repayment where it may assist resolution.

FAQ’s

Frequently Asked Questions

Clear answers to common questions about fraud and theft charges in Ontario.

01 What Does The Crown Have To Prove In A Fraud Case?

Generally, the Crown must prove a dishonest act, such as deceit or falsehood, and that it caused a loss or put someone’s financial interests at risk. The Crown must also prove that the accused knew the conduct was dishonest and could cause that risk.

02 Is Diversion Available For Theft Or Fraud Charges?

For some lower-level, first-time matters, the Crown may agree to diversion, which can lead to the charge being withdrawn after certain conditions are completed. Eligibility depends on the facts and Crown policy.

03 Should I Pay Back The Money Before My Case Is Resolved?

Get legal advice first. Repayment can be relevant to resolution or sentencing, but how and when it is made, and what is said about it, should be discussed with your lawyer.

04 Will A Fraud Charge Affect My Professional Licence?

It may. Many regulators require members to report criminal charges, and dishonesty allegations can lead to separate regulatory proceedings. We can help you understand your reporting obligations.

05 What If My Employer Has Accused Me But I Have Not Been Charged?

Speak with a lawyer before giving statements to your employer, investigators or police. Information you provide can later be used in a criminal case.
